These Terms of Service ("Terms") govern your access to and use of the dataspark.pro website, related communications and introductory information about DataSpark programmes and analytics services operated by DataSpark Pte. Ltd., a company registered in Singapore with UEN 202534918M. By accessing this website, you agree to these Terms. If you do not agree, please discontinue use immediately.

1. About DataSpark

DataSpark is an enterprise AI analytics platform providing machine learning operations, predictive intelligence, governed data pipelines and professional services to Singapore organisations. We are not a marketing agency, web design studio or general IT outsourcing firm. Our offerings are described on index.php, programs.php and services.php and are subject to separate written agreements for paid engagements.

2. Website Use Licence

We grant you a limited, non-exclusive, non-transferable licence to access and view website content for legitimate business evaluation purposes. You may not copy, scrape, mirror, frame or redistribute website content for commercial purposes without prior written consent. You may not attempt to gain unauthorised access to our servers, interfere with site security or use automated tools to harvest data from dataspark.pro.

3. Account and Enquiry Submissions

When you submit information through our contact form, you represent that the information is accurate and that you have authority to provide it. You must not submit unlawful, defamatory or malicious content. Our contact form includes a honeypot field; automated submissions detected through this mechanism may be silently discarded. PDPA consent is required for processing as described in our Privacy Policy.

4. Programmes and Services

Descriptions of DSX-101 through DSX-601 programmes and analytics services on this website are informational and do not constitute binding offers. Pricing shown as "From S$..." indicates starting rates and may vary based on cohort size, customisation and scope. Binding terms for programme enrolment or professional services are set out in separate statements of work, master service agreements or enrolment forms executed between DataSpark and your organisation.

5. No Guarantee of Outcomes

Enterprise AI and analytics outcomes depend on data quality, model architecture, integration complexity, organisational readiness and human oversight. DataSpark does not guarantee specific prediction accuracy rates, forecast performance, regulatory approvals, uptime levels beyond contracted SLAs or financial return on investment. Statistics displayed on this website represent platform benchmarks and illustrative metrics unless expressly guaranteed in a signed agreement.

6. Intellectual Property

All website content, including text, graphics, logos, programme structures, pipeline nomenclature and visual design, is owned by DataSpark Pte. Ltd. or its licensors and protected by applicable intellectual property laws. The DataSpark wordmark and DSX programme codes may not be used without permission. Client data and models developed under paid engagements remain subject to contractual intellectual property allocations specified in individual agreements.

7. Third-Party Services and Links

This website may reference third-party tools, fonts or infrastructure providers. DataSpark is not responsible for third-party terms, availability or data practices. Links to external sites are provided for convenience and do not imply endorsement.

8. Disclaimer of Warranties

The website and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the website will be uninterrupted, error-free or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by Singapore law, DataSpark Pte. Ltd. and its directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of this website or reliance on its content. Our aggregate liability for direct damages related to website use shall not exceed one hundred Singapore dollars (S$100) unless otherwise required by mandatory law or specified in a separate paid services agreement.

10. Indemnification

You agree to indemnify and hold harmless DataSpark from claims, losses and expenses arising from your breach of these Terms, misuse of the website or violation of applicable law, except to the extent caused by DataSpark's wilful misconduct.

11. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Singapore. Any dispute arising from or relating to these Terms or website use shall be subject to the exclusive jurisdiction of the courts of Singapore, without prejudice to DataSpark's right to seek injunctive relief in any competent jurisdiction.

12. Modifications

We may revise these Terms at any time by posting an updated version on dataspark.pro with a revised effective date. Material changes will be communicated where practicable. Continued use after changes constitutes acceptance of the revised Terms.

13. Severability and Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force. Failure to enforce any right under these Terms does not constitute a waiver of that right.

14. Entire Agreement for Website Use

These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and DataSpark regarding use of dataspark.pro. They supersede prior oral or written understandings relating to website access. Paid programme enrolment and professional services are governed by additional contracts that prevail over these Terms where conflicts arise.

15. Force Majeure

DataSpark shall not be liable for delays or failures resulting from events beyond reasonable control, including natural disasters, government actions, telecommunications failures, pandemic restrictions or infrastructure outages affecting Singapore or Asia-Pacific hosting regions. We will use reasonable efforts to restore website availability and notify affected enquiry parties where practicable.
